Privacy Policy
1. Definitions
In this privacy policy, the following definitions are used:
Tricia Mark Coaching: the user of this privacy policy; the sole proprietorship Tricia Mark Coaching, located at Rijksstraatweg 92, 1115 AV Duivendrecht, registered with the Dutch Chamber of Commerce under registration number 92607160, and affiliated with Beroepsvereniging Leefstijlcoaches Nederland (BLCN);
data subject: the natural person who (on behalf of a company) has entered into an agreement with Tricia Mark Coaching, or the natural person who (on behalf of a company) has contacted Tricia Mark Coaching in connection with the creation and/or performance of the agreement, or the natural person who (on behalf of a company) visits the website;
agreement: the agreement between Tricia Mark Coaching and the data subject under which the data subject uses the services offered by Tricia Mark Coaching;
website: the website www.triciamark.com managed by Tricia Mark Coaching;
profiling: the processing of personal data in which, based on personal data, certain personal aspects of the data subject are evaluated with the aim of analysing or predicting personal preferences, interests, online search behaviour, or location;
personal data: data that can be used to identify a natural person.
2. Personal Data
For Tricia Mark Coaching, careful handling of personal data is of great importance. With regard to the processing of personal data, Tricia Mark Coaching acts in accordance with applicable laws and regulations.
Tricia Mark Coaching handles personal data with care and treats them confidentially.
Tricia Mark Coaching collects personal data when the data subject provides this data, for example through the website, via email, by phone, or when the data subject is already a client and fills out an intake form.
Tricia Mark Coaching collects and processes the following personal data:

data provided through intake forms;

Tricia Mark Coaching does not process special categories of personal data.

However, Tricia Mark Coaching cannot verify the age of website visitors. 3. Legal Basis and Purposes of Processing
The legal basis for processing personal data is the performance of the agreement, or, at the request of the data subject, taking pre-contractual measures, or the legitimate interests of Tricia Mark Coaching in maintaining business operations and communication, or consent of the data subject (for future newsletters).
Tricia Mark Coaching collects and processes personal data for the following purposes:
handling a question and/or comment from the data subject;
providing an offer to the data subject;
entering into and performing the agreement;
contacting the data subject in connection with the execution of the agreement;
maintaining a client relationship with the data subject;
handling a payment;
maintaining client administration;
sending invoices;
complying with administrative obligations;
improving the website and services of Tricia Mark Coaching;
generating general statistics regarding the use of the website.
Providing the personal data listed above is a contractual requirement. Without this data, no agreement can be established.
Tricia Mark Coaching will not retain personal data longer than strictly necessary to achieve the purposes described above.
Tricia Mark Coaching processes only the minimum personal data necessary for each purpose and strives to minimize data processing.
Personal data will not be processed for purposes other than those described above.
4. Profiling
Tricia Mark Coaching does not conduct profiling and does not use tracking cookies or behavioural advertising tools such as Facebook Pixel or Google Ads.
If Tricia Mark Coaching introduces profiling in the future, this will only be carried out with the explicit consent of the data subject.
5. Newsletters
At this time, Tricia Mark Coaching does not send newsletters.
If newsletters are introduced in the future, these will only be sent if the data subject has given explicit and unambiguous consent. The data subject may unsubscribe at any time, as described in Article 6.
Tricia Mark Coaching will not contact the data subject for direct marketing purposes without prior consent.
6. Unsubscribing from Newsletters
If newsletters are introduced, the data subject can unsubscribe by:
clicking the unsubscribe link included in each newsletter;
contacting Tricia Mark Coaching via the details listed in Article 12.1.
7. Deletion of Personal Data
Tricia Mark Coaching will delete personal data without unreasonable delay if:
the data is no longer necessary for the purposes for which it was processed;
the data subject objects to the processing and the objection is justified;
the personal data is incorrect or outdated.
Tricia Mark Coaching is not obliged to delete data if one of the legal exceptions applies.
8. Disclosure of Personal Data to Third Parties
Tricia Mark Coaching will not disclose personal data to third parties unless:
explicit prior consent has been obtained from the data subject;
a legal basis applies which permits such disclosure;
disclosure is necessary for the performance of the agreement;
disclosure is made to a processor engaged by Tricia Mark Coaching, with whom an appropriate data processing agreement is in place.
The data subject may withdraw consent for disclosure at any time.
9. Access, Portability, Rectification, and Deletion Rights
Upon request, Tricia Mark Coaching will provide the data subject with access to all personal data held and will provide a free copy in a portable format, enabling the data subject to share it with third parties.
The data subject may request correction or deletion of incorrect data.
Requests can be submitted by email or in writing via the contact details in Article 12.1. Tricia Mark Coaching will respond as soon as possible and within 4 weeks.
10. Objection
The data subject may object to the processing of personal data if there are reasons relating to their specific situation. Tricia Mark Coaching will cease processing unless compelling legitimate grounds override the interests of the data subject.
11. Right to Restriction
If a data subject has submitted a request regarding correction, deletion, or objection and the processing of the request requires time, the data subject may request the restriction of processing.

14. Privacy Policy of Third Parties
This privacy policy does not apply to third-party websites or applications linked through the website, such as social media platforms. Tricia Mark Coaching is not responsible for how these third parties handle personal data. Data subjects should consult the privacy policies of those third parties.
15. Changes
Tricia Mark Coaching reserves the right to unilaterally amend this privacy policy. The latest version will always be published on the website.
16. Data Breach
If a security incident occurs involving personal data that may have serious consequences for the protection of processed data, Tricia Mark Coaching will notify the Dutch Data Protection Authority within 72 hours where required and act in accordance with the applicable guidelines.
If the data breach poses a risk to the data subject’s privacy, the data subject will be notified immediately.
17. Cookies
Tricia Mark Coaching uses only functional and analytical cookies.
A cookie is a small text file that is stored in the browser of the device of the data subject during the first visit to the website.
Tricia Mark Coaching does not use tracking cookies and does not use cookies for personalised advertising.
